Abstract


Mixed tribunals (hybrid tribunals / courts) to the joint efforts of the international community and the commission of the offense , together constitute the international legal persons and domestic legal persons , the range of offenses occurred within a specific period of one country (usually including international crimes investigation, prosecution , the trial institutions and domestic crimes ) . The reality of the generation of mixed tribunals is deeply rooted in the development of international criminal justice system and the international community , and the inheritance and development of the previously existing practice of international criminal justice . At present, the international practice of mixed tribunals include : Decree No. 64 team in Kosovo , East Timor special panel of serious crimes , the Special Court of Sierra Leone , Bosnia and Herzegovina War Crimes Chamber , Extraordinary Chambers in Cambodia , and Lebanon's Special Court . This article aims to explore the causes of a mixed tribunal of the existing practice of comparative analysis , this paper is divided into four chapters . In the first chapter , an overview of mixed tribunals . The chapter begins with an introduction to the concept of a mixed tribunal system idea , and then on mixed tribunals is a new development of international criminal justice system and its main causes were analyzed . In the chapter on the basis of comparative analysis of the existing practice of the mixed tribunals . Chapter II , the establishment of mixed tribunals . The mixed tribunals set up the way to the main line , a mixed tribunal practice is divided into three categories, respectively, the presence of the governing body of the crimes took place through the United Nations issued a decree to establish ; countries and the ad hoc International Criminal Court entered into an agreement to set up ; by The United Nations signed an agreement to set up with the countries concerned . By showing the practice of mixed tribunals set up different background , this chapter reveals a mixed court has broad applicability . The third chapter , the institution of mixed tribunals set up , the composition and jurisdiction . The introduction of the practice of mixed tribunals , setting , composition and jurisdiction of the chapter to show the diversity and flexibility , the practice has unified the title of the \Chapter 4 , the actual operation of the mixed tribunals . Be introduced on the basis of the practice of mixed tribunals in this chapter how to effectively run summed up the experiences and lessons learned . Finally, the conclusion that the mixed court has broad applicability and broad development prospects .
