Abstract

With the economic globalization and modernization process accelerated,the expansion of human activities in space,the strong impact of Western sports in modern times,and with the lack of necessary protection,the existing space of unique Chinese traditional sports is facing serious destruction,and its development is faced with the dilemma.A sound legal system and strong awareness of the law are important symbols of the modern country,as well as the only way of human civilization to a higher stage.It can be said that the legalizing protection of China’s traditional sports culture is invaluable in the aspects of Chinese traditional culture’s propaganda, sports heritage’s protection,sports culture’s education,as well as the development of the sports industry and so on.However,literature search found that the protection about Chinese traditional sports cultural heritage is a matter for the last ten years,the related research mainly focused on the martial arts and that the research is less than perfect and not systematic.Protection of cultural heritage has become consensus in the social,economic,cultural and any other fields.In this background,it is urgent that we should use laws to protect Chinese traditional sports culture heritage.As a result,using surveys of experts and system analysis method,this article researches on the present situations,the influencing factors and countermeasures of the development,and draws preliminarily the following conclusions:1.The protection work of culture heritage in China has scored tremendous achievement, and a protection network,which includes the international protection,national protection, academic protection,educational protection and the industrial protection,has basically taken shape.However,during the legalizing course of protecting Chinese culture heritage of traditional sports,there still exist some situations such as legal property is ill-defined,the concept of legalizing protection is vague,system of laws and regulations is incomplete,the enforcement is lax,education is poor and the level of public participation is low and so on.2.The main influencing factors are as follows:Government’s level of awareness, Government’ s policies and monitoring effectiveness,level of people’s ideology of the rule of law,the investment on management funds and protecting agencies in accordance with law.3.The legislation of Chinese traditional sports culture heritage protection law should follow "people first" principle,as well as the principle of rational use.The guiding ideology of legislation that both protection and development are important should be established to ensure that legislation should be corresponding to relevant laws.4.Chinese traditional cultural heritage protection law sports The specific design of the system should set up committee of experts,determine the standard and the main body of protection,establish the directory system,determine the transmission system and security system and set up a legal relief mechanism about protecting Chinese traditional sports culture heritage.5.During the course of enforcement about Chinese traditional sports culture heritage’s legalizing protection,the law enforcement should be strengthened through ways of government and society coordinating,single law and the national law uniting.6.In the aspect of promoting Chinese traditional sports culture heritage’s protection,the scope of protection should be extended.In addition,we should establish the concept of comprehensive protection,improve the level of public participation and strengthen protecting the inheriting people.7.According to Chinese situations and the present situations of Chinese traditional sports culture heritage,the government should build corresponding checking and comparing system,so as to protect Chinese traditional sports culture heritage from regulations and systems,using it as the powerful codes.8.Based on the successful experience of western countries’ legalizing protection about the culture heritage,according to the present situations about Chinese traditional sports culture heritage,this study puts forward the countermeasures about the legalizing protection of Chinese traditional sports culture heritage.As to the theory,this will provide a theoretical research basis for dissemination of the excavation of the Chinese traditional sports culture heritage’s legalizing protection,and provide an opportunity and the basis of methodology for its education.As to the content,this study explores the influencing factors about the legalizing protection of Chinese traditional sports culture heritage and builds a set of protecting system based on law,so as to ensure that work of protection has corresponding laws to follow.
