Abstract


The core of the spirit of volunteerism is the ideal of unity and common to make the world a better belief . The volunteers have their existence and development of the intrinsic value of the lack of the necessary legislation to protect the interests of the volunteers, the lack of effective protection , there are many problems in the volunteer service . The volunteers legislative formulation not only directly related to the volunteers, volunteer organizations , rights issues, but also to the right to freedom of association and labor rights of citizens , legal persons and individuals . In China , is still without a dedicated adjustment volunteer service volunteer law to regulate legal provisions for voluntary activities are scattered throughout various departments method presents a different legal effect level . Existing normative legal documents can play a certain extent, to adjust the role of the volunteer activities , but because of its legal position is not high , fuzzy law enforcement body , practicality is not strong, the imbalance of the provisions of the rights and obligations of the reasons unable to effectively adjust the legal relationship of a variety of volunteer activities . Very necessary to develop a unified volunteer France . In this paper, the rights and interests of volunteers in volunteer service activities by damage to the maritime search and rescue volunteers in Xiangshan County , Ningbo City , Zhejiang Province as a case study , learn from foreign advanced legislative experience , the reality of our country to protect the rights of volunteers a preliminary study . The article detailed the rights of volunteers , especially the rights of the training proposed financial security and the establishment of an insurance mechanism to establish the responsibility of voluntary organizations and service objects , the establishment of a volunteer relief mechanisms , to better protect the interests of the volunteers . Recommendations from a legal perspective : the establishment of dedicated volunteers, law , and improve the volunteer registration system , and establish an incentive mechanism ; and Recommendation: Government should encourage policy support , risk management and avoidance , broaden the sources of funding of the voluntary service will be volunteers into the social security system .
