Abstract


After nearly three decades of development, china’s real estate has become the foundamental and pillar industry of the national economy. With the rapid development of the real estate industry and the increasing market competitition, in order to gain more profits, real estate enterprises use a variety of ways to compete with each other. China’s economy at the first Magna Carta, "the anti-monopoly law," introduced the occasion, I attempted to "anti-monopoly law," the field of vision to the classic theory of industrial organization the main line of the SCP paradigm, from the Chinese real estate market, industry structure of real estate enterprises by means of commonly used analysis of competition, will be one of unfair competition to their monopoly into the "anti-monopoly law," the regulatory system to regulate the competitive practices of real estate companies, real estate market to maintain fair and effective competition in order and safeguard the interests of consumers.The full text is divided into seven parts, the following are the main contents of each chapter an overview of:Introduction Part : the status quo through the introduction of China’s real estate industry, leads to questions.Chapter I: Analysis of the structure of China’s real estate market. The real estate market by market concentration, product differentiation and barriers to market entry analysis, pointing out that the structure of our country the characteristics of the real estate market and came to the conclusion that our country is a regional real estate market in an oligopoly market conclusions. Chapter II: From the perspective of game theory, on the analysis of competitiveness of China’s real estate business conduct, I study the real estate enterprises in our country on a competitive basis, and I think non-price competition be the dominant strategy. And the vision of the scope of anti-monopoly law on real estate is used for analysis of competitive behavior,therefore this paper identifies the requirement to study the competitive behaviors.Chapter III: From what ought to be two levels and what is contingent on China’s real estate between the analysis of horizontal monopoly agreements that exist between China’s real estate horizontal monopoly agreements, such acts of unfair competition should be subject to anti-trust regulations system. And taking into account foreign legal monopoly on the horizontal regulation system protocol of the system in order to China’s real estate business on the horizontal monopoly agreements between the anti-trust regulations must have reference.Chapter IV: Chapter III of this paper and are parallel to the structure of our country, I consider the existence of monopoly pricing of real estate companies of unfair competition, and anti-monopoly law should be subject to regulation. Reference to foreign legal regulations related to the system of monopoly pricing and monopoly pricing which the general method of introduction.Chapter V: an analysis of the real estate business will be unfair competition into the anti-monopoly regulations to the need for anti-monopoly law on our country for real estate enterprises horizontal monopoly agreements and the conduct of monopolistic pricing regulations put forward the idea.Conclusion Part : There are many unlawful acts exist in real estate enterprises improper competitive practices in China, such acts should be included in the adjustment of the scope of anti-monopoly law. Acts of unfair competition which are attached to the real estate industry and the existence of market structure, and anti-monopoly law-competitive behavior of the real estate business regulation, is not easy from the current status of the real estate industry, but the real estate industry is determined by market structure. Anti-monopoly laws on unfair competition in real estate business for the purpose of the regulation system, are in order to act through the regulation so as to enhance the market structure finally, only by this, the real estate market can achieve a legal, and orderly competitive order.
