Abstract


Since the AIA insurance company introduced the concept of insurance agent into China in 1992, insurance agents have palyed an important role in the development of our coutry’s insurance industry,and also pushed the advancement of the insurance agents’ legal system. In 1995, Law of Insurance first made a rule about the conception of insurance agent. Then in 2002, Law of Insurance added the sytems "Agency Agreement", "Delegated Authority", "Prohibiting the Personal Insurance Agents Accepting Commission from Two Life Insurance Companies at the Same Time", "Agent Commission", "Training and Manipulation of Agents",etc. in the process of modification, which brings further development of insurance agent system. However, with the gradual maturing of our country’s insurance market, our insurace agent systems, especially the issues resulting from the incompletion of the personal insurance agent systems were increasingly exposed, which seriously deterred the insurance intermediary market from developing, and also disturbed the insurance consumption market’s order. Therefore, in this article, it thinks that the personal insurance agent is just a businessman, and that the research on the personal insurance agent systems should be beginning from the main business bodies, business actions and business agencies, in the way of practical research and comparison research; base on these, then it makes a description and analysis about the general theory, legislation policy, practical action and current system of the personal insurance agent systems, and partially restructure and adjust our country’s personal insurance agent system, to make the current 1,500,000 personal agents become the really legal personal insurance ones.
