Abstract


The rural credit cooperative is a kind of local financial organization which takes democratic member control with farmers as shareholders.It aims to provide financial service for the members with the farmer as service object and rural areas as service areas.During more than fifties years since the foundation of the rural credit cooperative,it has contributed greatly to the rural finance,which holds the important position in rural financial system.The reforms on rural credit cooperatives have been being carried out since 1980s and there has been a series of system changes.However,due to various reasons,there are some problems on self poisoning, property system,operation mode,operation costs,management system,external environment and so on.How to solve these problems is about the future development. of rural cooperative financial system.Besides intensify the internal reform,it is necessary to learn successful experience from developed countries.In this paper,on the basis of analysis of the existing problems in the rural credit cooperatives,the situation of rural cooperative financial system in developed countries is introduced,and provid legal suggestions to Chinese rural credit cooperatives.In Part One,it analyzes the new round reforms,setting the stage for discussing the problems in rural credit cooperatives.In Part Two,it introduces the problems in the process of reforms and development of the rural credit cooperatives,mainly including property system,operation and management,external environment and so on,and analyzes some aspects should be further reformed.In Part Three,introducing the typical modes of rural cooperative financial system in developed countries,it points out different traits of various patterns,finding out the similarities and differences.In Part Four,the paper states opinions to solve the problems on the reforms.The writer thinks that China should make special Law of Cooperative Finance as soon as possible,on the basis of which constitutes the perfect cooperative financial legal system.Law of Cooperative Finance should implement the cooperative principle, ensure independent operation of the rural credit cooperative and specify its legal position,design the basic management system,supervision and risk prevention mechanism for the rural credit cooperative.On the basis of Law of Cooperative Finance,combined administrative rules,government regulations should be more detailed and operable,which contributes to enforce the cooperative financial legal system and clear legal obstacles.Reinforcing the legal regulation in the reform process is the key point in this paper. Only in this way can we effectively promote the steady and effective reform measures, achieve the desired goals,promote rural financial market further prosperous and solve the problem of "Three Rural Issues".
