Abstract


\With international exchanges between countries deepened, consular protection is becoming increasingly important. Whether in practice or policy in academic research should be taken seriously enough. But now, for the issue of consular protection system, to fully explain the article and rare, therefore, the main purpose of this thesis writing consular protection lies in doing a basic legal questions Probe, to foreign consular protection around the theory and practice, sought through rational thinking and analysis, to seek consular protection legal system in China in the process of improving the practical problems encountered and solutions approach, in order to achieve a combination of theory and practice purposes. Consul system originated in medieval Europe, a period of time to get used to the more rapid development of the once fading, until the \Consular protection, specifically refers to the sending of diplomatic, consular offices or consular officials within the scope permitted by international law, the sending State in the receiving State to protect national interests, their legitimate rights and interests of citizens and legal acts. When its own citizens, the legitimate interests of legal persons operating in the country have been violated, the sending embassies and consulates in accordance with accepted principles of international law, relevant international conventions and bilateral treaties or agreements and the relevant laws of the sending State and the host countries, reflect the requirements of the host countries to urge the authorities according to justice, friendship, and properly handle. With the increased globalization of today's society, increasingly close international contacts, consular protection in international exchanges are also an increasingly important role in bilateral or multilateral consular treaties have sprung up, strengthen consular protection issues related to research is essential and urgent. In this paper, the structure is divided into introduction, body and conclusion of three parts. Among them, the body part is divided into three chapters. Preamble of the main topics of the era account of the background and reasons topic. The first chapter combed foreign consular emergence and development of the system, a comprehensive analysis of the development of consular protection system as well as the legislative consular protection system in our country's history, that \significant impact and positive significance.
