Abstract


Public participation in environmental impact assessment system is a central part in, whether it is for improving the efficiency of environmental development for democracy of environmental decision-making, comprehensiveness, and so has an irreplaceable role. Unfortunately,public participation in EIA in China is often a mere formality, the public’s right, participatory rights were ignored, even ignore, this also led to a series of sea tragedies. In order to avoid recurrence of the tragedy, increasing environmental decision-making more scientific and democratic, avoid public participation is formalized, in-depth study of problems in public participation in environmental impact assessment in China and analysis of its causes have become urgent practical needs. Therefore, this article intends to start with the current state, an in-depth analysis of public participation in environmental impact assessment in China legal issues, find out the cause of causing it, and propose appropriate solutions. Full text is structured as follows:ChapterⅠdivided respectively elaborated theoretical basis and practical needs of public participation in environmental impact assessment, pointed out that not only has a solid theoretical basis for public participation in environmental impact assessment, is also a real urgent need.ChapterⅡseparately in two parts explain the present situation of public participation in environmental impact assessment in China and noted that the legal issues, pointed out that China’s current status of formalization of public participation in environmental impact assessment, and in-depth analysis of the situation behind the public environment right and legal problems of the environment to participate were ignored and disregarded.Chapter III analyses causes of public participation in environmental impact assessment in China. Environment analysis of each of the two parts of the public right to information and protection of the environment to participate is not for legal reasons.ChapterⅣon public participation in environmental impact assessment study on the method of comparing the legal system, introduce foreign public participation in environmental impact assessment law system first, and then associate it with a comparative analysis of China, finally reached on the improvement of public participation in environmental impact assessment of the legal system in China. ChapterⅤis established on the basis of national conditions, made on the improvement of public participation in environmental impact assessment of proposals of the legal system.
