Abstract

No matter in Common Lawsystem or Continental Legal System,false evidence behavior is regarded as a crime to punish.On the basis of function of legal interest,the legal interest of the crime of false evidence can be divided into two types:the first one is to-be legal interest of the crime of false evidence;the second one is ought-to-be legal interest of the crime of false evidence.To-be legal interest of the crime of the false evidence is in terms of present criminal laws and regulations of China,such as Criminal Law,etc.,its function is to solve judicial problems .Ought-to-be legal interest of the crime of false evidence grounds on to-be legal interest of the crime of false evidence,its function is to perfect legislation of the crime of false evidence.On the basis of this theory, this article mainly disscussed the the limit of legislation about the crime in our country and proposed consumed suggestions.
