Abstract


In this paper, based on a real case in real life, the author according to the procuratorial organ Jia Mou prosecution to the defendant in the four counts of criminal legal issues involved in the extracts were discussed. On the basis of Jia Mou of each charges, in the case to question and use their knowledge and knowledge from the references in the reference to the doubtful points are given their own opinions and comments, at the same time, aiming at new problems in this case, the new situation put forward its own views and Suggestions. This article involved in the specific provisions of criminal justice problems not only contains the general provisions of criminal law and the problem, also includes substantive law and procedural law.
