Abstract


Judicial Authority refers to the judges in judicial organization should have the due authority and credibility in the activities of resolving litigation. The common establishment of judicial authority in the whole society is the necessary requirement and main indicator of modern legal society, and it is also the effective guarantee to ensure jurisdiction for become the ultimate mechanisms to resolving dispute, and also the reflection of party’s ministerial prestige and nation’s legal authority in the activities of justice. So it can provide legal guarantee for building a harmonious society. However, in china, the traditional rule of law is very weak and the main legal consciousness is rather worse, the shortage of jurisdiction become the biggest puzzlement in reality. What’s the cause of formation behind the shortage of jurisdiction? How to solve this confusion? It is of great theoretical and practical significance to research on these issues. In this paper, based on the basic meanings of judicial authority as starting point of understanding, we strive for make tentative exploration for judicial authority’s specific construction of our nation.We should strengthen our nation’s construction of judicial authority from the following aspects: First of all, we should make the reform of judicial system, in order to create a good condition to maintain the judicial authority. In addition, we should make further efforts to put jurisdiction into effect, increase the judicial examination power, change the current complexion which judiciary organization’s human and financial and material resources are under the control of local legislature, in order to ensure the independence of judicature;It is necessary for our nation to introduce the disciplinary procedures of contempt of court;Besides, we should also deal with accurately the connection between news supervision by public opinion and maintenance of judicial authority, make the two be coordinated and harmonized. Secondly, we must strengthen the judicial organization’s building and make great efforts to improve judicial impartiality and efficiency. We must set up a supervisory and disciplinary mechanisms to perfect the conduction of power,strengthen the efforts to penalize the activities violating law and discipline, in order to decrease corruption.In addition , we should pay attention to maintain the stabilization of judicial decision, practically solve the problems of difficult to perform via many kinds of routes.Thirdly, we should pay attention to bring up the public concept of law upholding. We must give more publicity to legal system, and devote major efforts to creating a atmosphere of advocating justice, trusting justice, subjecting to the justice, identifying with the justice, etc, in order to lay a good idea and public foundation for establishing the judicial authority, and finally make the judicial authority get people broad identification and support.
