Abstract


The scope of bankruptcy law is applicable bankruptcy law premise , our current bankruptcy law is one of the narrow scope of application defects , unable to adapt to the needs of the socialist market economy , this situation need to be changed . Throughout the history of the development Bankruptcy Law , Personal Bankruptcy is the originator of bankruptcy law , bankruptcy law throughout the development process. With the further development of the economy , the emergence of fiction person - body , the bankruptcy law began to extend the coverage of legal persons and other organizations . This article is based on the objective of China's socialist market economy, the actual idea of ??starting the new bankruptcy legislation , drawing attention to mature foreign legislative experience , the use of comparative analysis and historical research methods , to our country to establish natural necessity and possibility of bankruptcy system has been studied and presents the basic concept of natural insolvency regime .
