Abstract


QinQuan is provisions for minor children care parents all the rights and obligations of the legal system. Our country has no use QinQuan concept, also not set up QinQuan forming system. Although the QinQuan content of the provisions of the civil law referring to the legal provisions, but due to the strong principle, to judge handling increase the operation difficulty, also did not give the national a can abide by the rules. Parenthood complicated modern society cried out to complete QinQuan system establishment. Our country puts forward the proposal draft civil code for parents to take care of the minor children the right of a number of provisions, throughout the system with the rest of the world QinQuan system no substantial difference. According to China's existing laws have not been QinQuan establish and perfect the system, and perfect the system in QinQuan to all aspects of the proposal draft civil code, in view of the theory to explain and comment, and in all countries on the basis of reference for the law will be discussed. In order to be able to QinQuan system in our country the establishment, improvement of the proposed opinions put forward.
