Abstract


Mining enterprises workers in our country has been operating as a large-scale social groups , compared with ordinary workers , their own characteristics and work environment particularity them vulnerable to abuse than the general labor rights . Therefore , today an urgent need to solve the problem of the mine workers' rights protection . China has initially formed the legal system of of mining enterprises labor rights protection , but there are still some blind spots and blank spots , making these existing laws and regulations and did not get a very good implementation of the mine workers' rights , or to a large extent infringement , rights of way is full of hardships . The successful experience of developed countries such as the U.S. and Australia mining enterprises , protection of labor rights in its the complete sound laws and regulations , strict government supervision and management system , a sound system of corporate training and good production environment , a highly developed trade union organizations . Therefore , for the protection of workers' rights laws and regulations of China 's mining enterprises have yet to be perfect, mining enterprises industry self-regulation has not yet been established , the administrative regulatory model is not yet mature , the workers themselves low cultural quality due to a sense of law and the specific circumstances of the Perfection of mine the enterprise labor rights protection the following recommendations : to strengthen the mine laborers culture , technology education and training , to improve the overall quality of the workers of the mining enterprises ; improve the existing laws and regulations , and enhance the operability ; strengthen administrative supervision ; perfect victimized workers legal remedy.
