Abstract

Overseas investment insurance is a system that the country which export the capital executes to remedy non-business risk after it happens. By this means, the exporter wants to protect the investment in other countries. Overseas investment insurance system was initiated in 1948 in America. For its well effect, overseas investment insurance was adopted by many main capital output countries of the world.With the rapid development of the China’s economy, more and more domestic companies invest abroad. However, overseas investment legislation is extremely deficient, especially overseas investment insurance system. It is more important for us to build and perfect legislation about overseas investment in order to protect our overseas investment. Therefore, on the basis of the comparative study on the insurance scheme of the overseas investment, this thesis makes a preliminary research on constructing and perfecting the insurance scheme of our country’s overseas investment. Apart from the preface and the conclusion, this thesis can be divided into four chapters.ChapterⅠ:The outline of the foreign investment insurance. This chapter defines the terms:overseas investment, and overseas investment insurance, and discusses the definition, characteristics, value and history of the overseas investment insurance scheme, thus provides a foundation for the following discussion.ChapterⅡ:Deals with the comparative research on the oversea investment insurance scheme of the main countries in the world. Similarly, this chapter takes America, Japan and Germany as objects and analyses them in comparative methods. Specifically, first to schematically elaborate on the main contents of the overseas investment insurance scheme of the three selected countries from the perspectives of scheme model, insurer, insured, objects insured and insurance coverage etc. And then, makes a comprehensive comparison and analysis on the overseas investment insurance scheme of the above-mentioned three countries from the comparative angle in the hope of providing some beneficial references to constructing our country’s the overseas investment insurance scheme.ChapterⅢ:An analysis of the necessity and feasibility the overseas investment insurance scheme in China. This part mainly devotes to China’s practical conditions. First, it studies the current development conditions of China’s oversea investment and of the legislation of China’s oversea investment. At last, it discusses the conditions of the oversea investment insurance legislation and analyzes its feasibility.Chapter IV:deals with the perfection of international factoring in China. This chapter Put forward to related suggestion for constituting the law of investment insurance scheme in our country to offer a little benefit for future law making.
