Abstract


With the rapid economic development, the thoughts and behaviors of peasants are in a transition from traditional ethnics to rationalizations in the rural society. This change will definitely reflect on the choices of the ways to settle the rural disputes. The occurrence and solution of disputes are closed with the social changes. Form the research about the disputes in the rural and the settlements, we can find the level of social economic development and people’s ideological conception.This thesis is guided by theories and methodologies of sociology. On the basis of the survey of maliangang town, we understand the current situation of rural social disputes, summary the characteristics of farmers and analyze the reasons of farms’behaviors. Then we can give some advises about establishing and perfecting diverse dispute settlement mechanism in the rural area.This article has five chapters or three parts. We have clearly understood the localization of farmers’ way to settle disputes. Firstly, this article presents the significance of this topic, the source and the related researches, the aims and methods in the thesis.Secondly, it searches the current situation of disputes because of rural social diversity and complication in the transformation period of. We can notice the informal and formal manners to settle the rural disputes. We have established plural dispute settlement mechanism, but the informal way play a more important role. Thirdly, it is mainly about the status of farmers’ way to settle disputes. Farmers choice’of settlements showed the features of sequential progression. If the disputes cannot be settled in low dispute resolution they will choose a higher manner. Then the judicial dispute resolution should become their last choice. Fourthly, there are three reasons to affect farmers’choice of manners to settle disputes. From the case of factors, nature of the case, the status of the party structure and the difference between the outcomes have a major impact on the choice of farmers’. From social factors, social consciousness, authorities agreement, the economic costs, the government’s lack of a formal dispute resolution mechanism and civil disputes adaptive outcome of the way are of great importance.Fifthly, We understand the social order in the social transformation period of rural society. The rural social life of "village community" still exists. The society’s basic situation of rural society as an acquaintance still retains. Modern rural society has legal requirements, so we should attach importance to the basic role of the folk norms, compensate the formally plural remedy mechanism, establish and improve the deficits of diverse dispute settlement mechanism in the rural.
