Abstract

For international shipping ballast water discharged by ships to bring marine invasive species problem is getting worse . Some developed countries such as Australia, New Zealand , the United States has enacted laws and regulations , the International Maritime Organization in 2004 also adopted the \China is also facing the same problem , at present China 's relevant laws and regulations and related measures are not perfect , the need to develop appropriate domestic law norms . Based on the ship's ballast water to prevent the invasion of alien species of marine law comparative study concluded Australia, New Zealand , the United States and conventions legislative experience , according to China's own characteristics to develop and improve marine ships' ballast water to prevent the invasion of alien species legislation. This paper is divided into four chapters . The first chapter is an overview and analysis of ships' ballast water to prevent the invasion of alien species of marine -related concept, the ballast water issues need to legislate and analysis of the international conventions and national issues concerning ballast water legislation profiles. Chapter II of the Legislative comparative study, the main use of comparative research methods, extraction conventions and Australia, New Zealand , the United States on the prevention of marine ballast water legislation, invasive species are more representative of a comparative analysis of several systems , including the management system with and implementation of the ballast water management plan system , ballast water reporting system , ballast water system and the penal system of records . The third chapter is the legislative trends , legislation through the second chapter comparing summed up international conventions and national ballast water issues on legislative trends . Chapter IV for the country's response , first analyzes of the current situation of ballast water legislation , discovered the problems in our legislation and to be explored. Then , based on the first three chapters , by drawing on international conventions and national ballast water issues legislative experience , proposed legislation to deal with our ideas , hoping to play a valuable role in our country to prevent the ships' ballast water marine alien species legislative intrusion benefit .
