Abstract


Economic globalization has become the trend of the world , foreign direct investment is increasingly becoming the process of economic globalization of national economies interconnected , interdependent basic approach , foreign direct investment , the flow and structure of the rapid changes in a country's economy has continued to develop steadily significant impact. China as a developing country in the overseas investment country, from the protection and promotion of foreign investment , and enhance our international competitiveness and position angle, we must further improve the legal protection of foreign investment regime , foreign investment enterprises to solve problems encountered in overseas investment improved management of overseas enterprises , and promote China overseas investment undertakings flourish further . This article from the perspective of starting capital-exporting countries , to study overseas investment laws assurance system , bilateral investment treaties, the Multilateral Investment Guarantee Agreements on the role of foreign investment ; and learn from the successful experience of foreign countries on the basis of the status of overseas investment in our country , for Perfecting China overseas Investment Act making further exploration and research . Text is divided into four chapters: Chapter clear legal regime for overseas investment related concepts , and briefly describes the system of overseas investment in the form of legal protection , the need for legal protection of foreign investment and foreign investment laws to protect significance. Chapter II compares and analyzes the major capital-exporting country's domestic foreign investment guarantee system , bilateral investment treaties and international multilateral investment protection treaties on foreign investment protection. The third chapter analyzes the current situation of overseas investment insurance system , bilateral foreign investment protection agreements to protect the status of overseas investment , MIGA protection status of China's overseas investment , overseas investment and make our country 's legal system to protect the existing problems . Chapter IV of overseas investment for the legal protection system problems , put forward suggestions for improvement .
