Abstract


Recall system for defective products is characterized as its special function of protection, prevention and promotion, it is a system of consumer protection that developed with the development of market economy, its emergence and development has a profound basis of philosophy of law, economics and sociological. In recent years, China’s product recall legislation is significantly accelerated, the number of product recalls has increased noticeably, but comparing to the developed countries, China’s product recall system is far from perfect. in view of the important role and China’s economic development, the author think that China should learn from the experience of Europe, the United States and other developed countries as soon as possible to improve our recalling system.There are four parts in this text except the introduction and conclusion. The first part is an overview of defective product recall system, mainly introduces the basic theory of defective product recall system.The second part mainly introduce the defective products recall system abroad, in this part, the author give a comparative study on defective products recall system from the legislative system, the definition of defective products, the subject, the way, the procedure and liability, etc.The third part is about the status quo of China’s product recall system, which mainly describes China’s product recall system in the legislative status, implementation and the existing problems.The fourth part is the improvement of China’s product recall system, in this chapter the author gives some advice to improve our recall system based on the research of the previous chapters. These advices including the development of "defective product recalls Law", improve product defect identification standards, improve the product recall procedures, strengthen the responsibility of product recalls and improve the related system The author hopes that this text is helpful to improve our defective product recall system.
