Abstract


The era of knowledge economy, the competition of the enterprises and the countries is a large extent of intellectual property competition, so all the multinational companies competing intellectual property as the focus of the chase, and intellectual property protection as the important consideration of foreign investment. Therefore, the country’s intellectual property protection of multinational companies will directly affect the dynamics and the investment in the country, and then affects the economic development. China as the world’s most attractive investment, high quality in order to continue to attract foreign investment to come, we must face the protection of intellectual property rights. Due to the protection of intellectual property rights in late start, the intellectual property rights protection system is not perfect, the intellectual property rights owned foreign provide full and effective protection to the extent that the restriction of the foreign investment in China. How effective protections of intellectual property rights, and actively guide foreign investment in China’s current use foreign capital and the work of intellectual property protection center. From this point, the study of the utilization of foreign capital in china, intellectual property protection problems have strong practical significance.This thesis on international direct investment problem of the intellectual property rights system compares the study. The first chapter is introduction, including this thesis writing part of purpose and meaning, the present situation and the framework and research papers. The second chapter is to the protection of intellectual property and the dialectical relationship between international direct investment analyses. This chapter in economics theory and the law of many theoretical bases, this paper focuses on intellectual property protection for international direct investment effect. The third chapter mainly discussed the international direct investment in intellectual property protection, the three key problems of intellectual property investment, abuse of intellectual property right and intellectual property loss problems. The fourth chapter in general descriptions of international investment in the current intellectual property protection based on analysis of the third chapter of intellectual property protection on the international direct investment, perfecting of intellectual property protection, accelerate the utilization of foreign capital, and proposes countermeasures. Through the analysis, strive to achieve the purpose of the following:in intellectual property protection and the dialectical relationship between international direct investment, based on people using foreign capital to realize the importance of protecting intellectual property rights, and hope that through the analysis of intellectual property protection in China, the existing problems and puts forward some corresponding countermeasures for our government departments and enterprises to formulate relevant policies and decisions for reference.
