Abstract

According to research, the national debt activities for human society is not unique to the product of capitalist society the Treasuries activities of the Slave Society has produced, but smaller then the size of the debt, not yet a larger impact on the economy. Modern times Treasury activities are always accompanied with the war, the national debt has become a war an important fund-raising mechanism, which is the national debt hidden character. Mankind enters the capitalist society, capitalist society since the Great Depression, the countries through the issuance of government bonds to make up the budget deficit and stimulate economic development. At the same time, many countries also issued government bonds legal norms. In our country in recent years, the bond market has made considerable development, especially since the Asian financial crisis in 1998, the state through the issuance of government bonds to stimulate economic development, and achieved significant results. At the same time, our national debt and legal system is seriously lagging behind, which is one of the main reasons there are many problems in the National Debt. The Treasuries law is an important part of the legal system of the socialist market economy, and to protect the government bond market and healthy development, to make up for the lack of fiscal revenue, regulating the development of the inter-district economic injustice. In view of this, how to formulate the the Treasury law, in order to protect the healthy development of the government bond market is worth studying. The third part of the \The fourth part of the \This section analyzes the nature of the law of the national debt, and proposed the National Debt legislative mode, the principle of the system of, and Treasuries law legislation. This paper argues that the National Debt Legislation should adhere to the legal principle of government bonds, government bonds of the principles of democracy and government bonds in sound financial principles. Based on the fiscal principle of the rule of law, build the basic content of the National Debt Act legislation, including: government bonds issued by the examination and approval system, the system of issuance of treasury bonds, treasury bonds circulation system, the the bond reimbursement system, the national debt management system and liability.
