Abstract


Smart IC card system to rely on control hardware , a combination of software and smart , contains a variety of high-tech applications , whether it is the protection of patents, copyrights or trade secrets rights are not complete will be included in the scope of protection in the protected object protection the scope of protection period has its own deficiencies. IC card intelligent systems is developing rapidly , good prospects , is in the continuous development of the peak of a new and higher requirements , which made ??the existing system of intellectual property protection . By case empirical seriously study the relationship between the IC card intelligent systems and intellectual property rights , to investigate the condition and problems in China 's smart IC card system of intellectual property protection , smart IC card system of intellectual property protection recommendations put forward a sound . This paper is divided into three parts , the first part , cited a typical case of two smart IC card system of intellectual property protection , legal issues embodied in the analysis of the case . The characteristics argumentation on second part , through case studies and problems raised smart IC card system characteristics , the use of intellectual property protection jurisprudence combined with smart IC card system of intellectual property protection of patents, copyrights and trade secrets rights in the smart IC card system knowledge the advantages and shortcomings in the protection of property rights . The third part , based on reasonable proposals based on the analysis of the second part of the smart IC card system and similar high-tech intellectual property protection . I believe that , corresponding to the characteristics of IC card intelligent control system , patents , copyrights and trade secrets rights protection has its own advantages and disadvantages , strengthen smart IC card system and similar high-tech intellectual property protection , enterprises should strengthen intellectual property management , the combination of patents, copyrights and trade secrets , and flexible use .
