Abstract


Administrative accountability is an important measure of our government to ensure that its responsibility. In recent years, China's government in the practice of administrative accountability achieved remarkable results, and at the same time carry out a positive discussion of administrative accountability theory. However, due to the lack of emphasis on on allogeneic accountability mechanisms, especially the public participate in the supervision of administrative accountability, making this our administrative accountability system for all obstacles encountered in the build process, the administrative accountability actual effect not ideal. Therefore, the research on the specific path of our citizens to participate in the administrative accountability is very necessary. Through the practice and theory of Western citizen accountability of specific practical results of the comparative analysis of our citizens accountability path to identify the many factors that hinder our citizens to participate in the administrative accountability, and eventually proposed to increase the effectiveness of our citizens to participate in the administrative accountability specific measures. The structure of this paper is divided into six parts: Part I: Introduction. Introduces the background and significance of the thesis topics, the research status at home and abroad, research methods, and innovations of this paper. Part II: defining the concept and connotation of administrative accountability and citizen accountability, and start from the democratic political theory, the principal - agent theory and public choice theory, demonstration of citizen participation in the administrative accountability the reasonable and legitimacy foundation. Part III: Introduction foreign citizen participation, administrative accountability, including opinion polls, public hearings, the pressure of interest groups, administrative public interest litigation and constitutional litigation. On this basis, the analysis of the accountability of these types of citizen participation at this stage of our citizens accountability path build useful reference. Part IV: summary and analysis of the current path of our citizens to participate in the administrative accountability from the system level and non-institutional level. Which the system path is divided into letters and visits, administrative litigation and administrative reconsideration, non-institutional path supervision. Analysis of the existing path of our citizens to participate in the administrative accountability, its purpose is to understand the status of our citizens to participate in the administrative accountability, laying the groundwork for the next part of the analysis of the effectiveness of our citizens to participate in the administrative accountability path and repressor factors. Part V: divided into two. Our citizens to participate in the administrative accountability the actual effect of the existing path analysis, come to our citizens to participate in the conclusion of low accountability effectiveness; existing path utility analysis to identify hinder our citizens to participate in the administrative accountability specific factors, including: accountability object and scope of uncertainty, lack of information disclosure mechanism, supporting program mechanism is not perfect, and lack of evaluation mechanisms, lack of accountability of the path, and a poor sense of civic accountability. Part VI: On the basis of our citizens to participate in the effectiveness of accountability and Inhibitory Factor Analysis, has put forward countermeasures to improve our citizens to participate in the validity of administrative accountability. On one hand, it is proposed to increase the the citizens foundation of the effectiveness of the system of accountability, including: clear the object and scope of citizen accountability, strengthen the construction of information disclosure system, improve citizen accountability procedures mechanisms, develop supporting civic accountability assessment mechanism, improve citizen accountability path and reshape the civic culture of accountability; On the other hand, according to our citizens to participate in the actual development of the administrative accountability accountable for our citizens to participate in the new path: Administrative Public Interest Litigation path and hearings path design, respectively. specific operational process and path from the starting point of the path design, build three aspects of the analysis and design of the problems need to be addressed in order to benefit the perfect path of our citizens to participate in the administrative accountability.
