Abstract


Promote sustainable development era, the need for public participation in environmental protection has become an internationally accepted truth. Governmental environmental organizations as an integral part of the public, because of their professional, public welfare, grassroots and other characteristics, the Environmental Protection more and more important, has become an integral part of environmental protection as an important force. Environmental NGO in China started relatively late, but the rapid pace of development, especially in recent years the Chinese government continue to advocate for the protection of environment and economic development counterparts, such a policy environment, China's non-governmental environmental protection organizations in their own development, the role of play has made great progress, but compared with developed countries, there are still a lot of gaps and deficiencies. Such a difference is mainly due to the lack of suitable environmental NGO growth and the exercise of the right to participate in the rule of law in environmental protection. China's legislation has been formed as a guide to the Constitution, laws and administrative regulations, with the support of departmental rules and local rules, supplemented by general law and special wears a combination of legal and regulatory system. Objectively speaking, China's environmental NGO participation in environmental protection legislation system and constantly improve the participation channels continue to expand, expanding participation in space, a great improvement over the previous, and is in a stage of rapid development. But can be summed up from the effect of the implementation of China's environmental NGO participation in environmental protection in the overall lack of effectiveness. China's environmental NGO participation in environmental protection system is not yet mature, there are many defects. First, due to the limitations of the registration and management system, the environmental NGO in China to obtain a legal subject qualification is not an easy task; followed for the protection of the participation of the smooth progress of the environmental information disclosure system just \participation in environmental protection of the most important core mechanism - participation mechanisms there are serious deficiencies in the system, the government is always involved in the whole process of control initiative. To promote environmental NGO in China to play its due role in environmental protection, should first redefine the legal status of non-governmental environmental organizations, to amend the existing regulations of the relevant laws and regulations on environmental NGO, clear the nature of the non-governmental environmental protection organizations, improve the environmental NGO Secondly, in order to encourage environmental NGO participation in environmental protection, good system design should be involved in the timing, scope, methods, effectiveness, etc.; Finally, we need to improve the environmental NGO and the establishment of conditions of approval procedures and oversight procedures; the government's management mechanisms.
