Abstract


The presence of all the knowledge in the form provided for the development of society and the progress of mankind in the era of knowledge economy, the endless power. With the development of modern science and technology, the value of traditional knowledge is increasingly recognized for people and extensive use. But the resulting protection of traditional knowledge, especially the protection of intellectual property rights issues plaguing scholars and legislators. Subsisting and protection of traditional knowledge is facing a serious crisis, the traditional knowledge of communities, peoples and nations, especially the increasing demands for developing countries ask for legal protection of traditional knowledge. Side of the existing intellectual property laws to protect the importance of modern knowledge, while neglect of traditional knowledge as a source of intelligence for the modern knowledge prompted us to re-examine the formation of the intellectual property legal system has been 300 years. The combined effects of the cross-border use of traditional knowledge and intellectual property legal system, international trends, the traditional knowledge of intellectual property law to protect pushed into the international system built stage. From the 1950s to the present, there are a number of international organizations concerned about this issue and tries to give a solution that everyone can accept, but the result is not satisfactory. It is based on the background, I chose international legal protection of the intellectual property rights of traditional knowledge questions, problems benefit. Follow the \the need to build international legal protection of the intellectual property rights of traditional knowledge system, the idea of ??a system of legal protection, and that led to the WTO and WIPO, highlighting the central position of the TRIPs agreement, each of the relevant international organizations and the Convention on the division of labor, mode selection yuan , form a comprehensive, three-dimensional intellectual property international legal system of protection of traditional knowledge. Has a special significance for developing countries in view of the establishment of the legal system, I particularly put forward a set of practical legal initiatives to promote international legislation. Finally, focus on the actual situation of our country, from the legal system of intellectual property rights mainly supporting other laws with international legislative standards and recommendations to improve the legal protection of traditional knowledge.
