Abstract


In the process of China 's real estate sale , real estate sales contracts established entry into force and the immovable property rights registration between the poor often have a certain amount of time . Many real estate developers for a variety of reasons , did not apply for transfer procedures already pre-sales of commercial housing repeatedly betrayed or to set up a mortgage against the interests of the creditors , before the introduction of the Property Law of the People 's Republic of China \expected property rights powerless , that many cases are not fair and effective solution for the protection of creditors and the creditors signed a contract purposes can not be achieved . In view of this , select and measure the same time , legislators learn a foreign real estate registration system set out a registration system of China 's real estate notice , the right to be the subject of claims to real property transfer preservation of real property rights holders to prevent transactions frustrating the purpose . However, due to the relevant provisions of China 's property law is too general , especially real estate Property Registration notice of registration problems no detailed provisions , and how to improve China 's real estate notice registration system to make it better safeguard the legitimate rights of the parties interest in promoting real estate transactions security and stability on the swing in the front of us , the author combined Germany, Japan, of the Taiwan region of the corresponding system briefly from the meaning of the notice of registration of the nature , scope , elements , the force of law and our property rights law about the lack of notice to a registration system and other aspects of this elaborate , I hope to be helpful to be able to improve the registration system of China 's real estate notice .
