Abstract


With the development and advancement of science and technology, the activities of science and technology awards are launched extensively, and formulating the laws about science and technology awards is necessary. At present the laws and regulations related to science and technology awards are: "Regulations on State Science and Technology Prizes","Non-government force to set up science and technology awards management", "Law of the People’s Republic of China on Science and Technology Progress", and so on. Science and Technology Award basically formed the legal system, but generally carried out with the science and technology awards, technology awards system has been formed and there have some problems. The UK and China have different political and economic backgrounds, historical and cultural traditions, science and technology awards system is different, economic and technological development is not the same, which determines the legal system in China and the UK Science and Technology Award difference. Overall, the UK’s technology advanced, more developed science and technology awards, therefore, compared the Chinese and British scientific and technological incentives in different legal system, the Chinese can learn from the advanced experience of the UK, and has an important role in further improving the legal system in China.This paper exploit the methods of comparative analysis and give examples to analysis the difference between China’s and British’s subjective, objective, form and review process of Science and Technology Awards. By comparison points out the shortage of science and technology awards in China, and proposed how to perfect the science and technology legal system in China.Except the preface and conclusion, the paper is divided into six parts. The first part is the author introduces the role of the legal of the science and technology, and also introduces development of the two countries’ science and technology legal system.The second part is the comparison and analysis on the subjective of the science and technology award between China and the UK. There is also analysis the difference and the reason of the subjects.The third part comparative and analysis the difference of the science and technology award object between China and the UK, and in this part also point out the difference enlighten for China.The fourth part is comparative the form of the Chinese and British scientific and technological awards, point out the difference and this difference enlighten for China by analysis.PartⅤ, analysis from the review process, comparative the British and Chinese science and technology awards, point out the differences and Implications for China.SectionⅥpresents a recommend for our Country to perfect the legal system of science and technology award.
