Abstract


Voice right is a new type of itemized right of personality. In the legislation of many other countries, the right was legislation to independence. The voice to a man has an important social function, and it is an important personal element for personal development and improvement. Legal protection for the right of voice is of great significance for people’s freedom and dignity. In china, It is not deep and thorough enough in the study of the voice right, and the legislation about it has not been established. For promoting legislation to confirm and the judiciary to protect the right, there is a need to further explore the basic theories about the voice right and find the right place in the systems of the personality right.The paper, firstly from the physical properties of the voice to explore the Material conditions for the voice right to exist, and then will analysis the basis and value of the right to a voice. On this basis, it will discuss the definition of voice right and analysis its subject and object factors. Secondly, from the internal and external two points of view of rights system, the paper will dialectically discriminate and analysis the relation between the voice right and relative civil rights. Then will be the problem of the voice of the right to commercial use. Finally, through surveying the legislation of the other countries and regions and analysising the draft legislation of our country, the paper will give the legislative proposals that how to build our system of voice right.
