Abstract


Practiced in China since the reform and opening up, in the political field more outstanding problem is the duty crime, its direct relation to our country can protect the achievements of reform and opening up, maintain social stability problems. Face reality, learn from foreign advanced experience, out of the heavy penalty thought erroneous zone, a correct understanding of punishment and prevention in duty crime punishment to synchronize the role. The maintenance national security is of great significance. This article mainly from the perspective of criminology state personnel duty crime analysis of state personnel duty crime characteristics, state personnel should be how to determine the duty crime in our country and the development trend of the position, and then the cause of the crime and its shall take preventive measures are discussed. In the article the author think the state personnel shall be based on the duty crime prevention, weaving the strict system of the nets, prevent and punish the duty crime is the basic safeguard and the basic way.
