Abstract


To regulate the rules of contract construction is an important condition for the commercial activities under the Law. This paper puts the emphasis upon the maritime contracts basing upon the common theory of contract construction. Firstly, the study is given to the special characters of the maritime contracts and the construction thereof accordingly; secondly, several theories of common contract construction with close connection with maritime contracts are studied; at last, this paper concentrates on the rules of the construction of maritime contracts. Since Chinese law is on the basis of continental iaw, and, however, English law is prevailing in the field of maritime law, this paper puts the construction rules into the continental instruction and, at the same time, consults English law to a great extent. With the comparison of the two big law system, a way suitable to the practice of China may be achieved.
