Abstract


EnterPrise crime is a behavior that legal representative, attomey ordirect responsible personals of ellterprise authorized or permitted byenterprise policy-making body in order to seek profits implementintentionally or negligently It is a large obstruction in our modementerprise process, and does damage to market economyResearch an ellterprise crime must firstly describe the structure ofenterprise crime. The structllre of enterprise crime includes the subjectstructllre, the behaviors structure, the offense sttucture. Promulgating theessence of enterprise crime by the criterion of enterprise legal status, wedivide enterprise crime into corporate enterprise crime and incorporateenterprise crime. The former consists of company crime, the crime of theenterprise owned by the whole people and the crime of thecollective-owned eflterprise. The laller is composed of the crime of theeflterprise of individual investment and partnership enterprise crime.Corporate enterprise crime is corporate crime in essence; the crime of theeflterprise of individual investment; partnership enterprise’s stature incriminal law (the essence of its crime) must be analyzed concretely: unitcrime or the crime of the natural person.Analyzing its causes must adhere to the "dualism" method, exPoundthe causes of enterprise crime profoundly and over all at the present stagefrom two ways: social and individual.On basis of the causes of enterprise crime, fundamentalcountermeasures of controlling enterprise crime must be deposited andcombined organically, solve emphatically how to practice theadministrative structure of enterprise and how to deal with the problem"the intemal personal controlling" in order to implement its objectivemodel.
