Abstract

As the organ of violence, Prison is the country’s penal institution which undertakes the heavy task to punish and reform the criminals. Security and Stability of the prison is the basic work of every prison which is directly related with lasting political stability and social Harmon. Because of the its particularity, prison is the crossing and aggregating point of the various contradictions hiding of inducement of sudden events, so it is called the powder storage and crater. How to further to Constructing the emergency management system of sudden events scientific, rational and efficiently certainly becomes the basic work of prison. Especially in current position, establishing and perfecting the emergency management system of sudden events is particularly important. Constructing a perfect emergency management system of sudden events can not only bring the prison emergency management into standardization and legalization, improving the ability to prevent, disposing the sudden events, creating a overall, effective good environment for prison, maintaining social stability and harmony, but also can embody socialist legal and maintain the image of prison and our country.Although we have made an effective emergency management system and measures in the process of fulfilling function of prison, and accumulated some experiences, the management mechanism of emergency management system for prison in our country is still at an initial stage. Especially the research on the Systematism of emergency management is still a blank. Taking the emergency management system of prison as the research object, combined with management science, political science, law science, psychology, sociology and so on, integrated application of retrospect analysis from documents, comparative research, system analysis, case analysis and so on, according to the though of status research, problem finding, reason analysis, countermeasure research, this paper makes a systemic and explorative research on the emergency management system for prison of our country. Main contents including:First, the paper describes theory of prison emergency management, giving the specific definition of prison, prison emergencies, emergency management and other related concepts, which strongly and theoretically supports the paper. I addition, it also clarifies the necessity of China’s prisons emergency management.Second, the paper describes status quo and analyses the existing problems of China’s prison emergency Management by sorting out some main cases of prison emergency management system. The chapter straightens out the basic framework and summarizes lems in the emergency management of our prisons:in the aspect of legislative system, problems mainly refers to weak legislative foundation, absence of basic laws and regulations and lack of and.overall planning. In the aspect of management system, the lems mainly include the temporary institution of management of sudden events, low integration of related institutions and forces and low participation from the public. In the aspect of distribution of resources and other support, the problems include the insufficiency of-resources of sudden events and their insufficient integration. In the aspect of emergency supervision, there exist problems such as less continuation and weak supervision from the media. And thereafter, the paper researches the causes of these problems.Again,the paper describes the practice of prison Emergency Management from other countries for reference. Through comparative study of prison emergency management, including the United States, Britain, Germany, Japan and other developed countries, the chapter sums up the advanced experiences of these countries including:First, the establishment of a sound emergency management law system which not only includes fundamental laws but also offers sufficient support for prison related legislative process. Second, well planning of emergency management legislative process which allows the laws to cover in a more comprehensive way and work in a collaborative, efficient and concerted way. Third, the sound emergency management mechanism which is characterized by sufficient resources and their efficient allocation. Fourth, a comprehensive supervision system which strengthens the continuation of supervision and makes the supervision from the media work effectively. These experiences from developed countries provide us a useful reference for our prisons emergency management system.Final, the paper suggestions are put forward to solve the problems of prisons emergency management in our country so as to improve the level of the prison management. In the aspect of law system, the author suggests to update legislative concept, strengthen the legislative construction in a systemic way, establish legislative support mechanism and uplift the legislative planning. In the aspect of the management system, the author suggests to establish permanent emergency management institutions and emergency management network for sudden events. In the aspect of the allocation and provision of resources, the author suggests to construct a mutual aid circle to improving the functions of prison emergency resources system. In the aspect of supervision, the author puts forward suggestions of constructing all-process supervision mechanism and strengthening of media supervision.
