Abstract


Refusing to permit the right to rule of law given by the country as a modern relatives of witnesses to testify on particular circumstances from a right , is the exception to the obligation of witnesses in the world, many countries have clearly defined, our history, although there is no direct relatives the right to refuse to permit regulations, but the feudal patriarchal system under the \China's current criminal legislation in this important witness was missing right , this is mainly due , as we have been since the founding of kin the right to refuse to permit the feudal dross, and to some extent with the principles of Marxism goes against the facts . This paper through the concept of the right of relatives refused to permit understanding of current legislation and relatives the right to refuse to permit local conflict , reflected from relatives incriminating country and family , legal and moral contradiction and thus moral criticism of existing legislation .
