Abstract


In recent years , the number of multinational companies and research institutions in developed countries find valuable genetic resources in countries with rich genetic resources , and apply for a patent or the Protection of New Varieties of Plants , this kind of \attention. Life pirates ' behavior affects the interests of the majority of developing countries related to the interests of farmers and genetic resources , and also to some extent on the destruction of the ecological balance . On Plant Genetic Resources Organization of the United Nations FAO , the Convention on Biological Diversity , the World Intellectual Property Organization , and even the WTO to discuss the object . This paper describes the meaning and characteristics of plant genetic resources in agriculture , then in the discussion on the basis of the need for legal protection of plant genetic resources , international treaties related to plant genetic resources and our country can for the protection of plant genetic resources the relevant laws and regulations , has done a preliminary study on the legal protection of plant genetic resources mode , and recommended the establishment of a special legal system for the protection of agricultural plant genetic resources . Set up a special legal system for the protection of plant genetic resources at the same time raised a lot of specific issues , this article focuses on the rights of the name , the right to object , the subjects of rights , the duration of protection and the rights of the content .
