Abstract


Sinces the 20th century 90’s, along with telecommunications and technological advances, China’s telecommunications industry by leaps and bounds of rapid development, from a very low telephone penetration rate of telecommunications backward country became the world’s largest telecommunications users the world’s largest telecommunications market . But behind the appearance of prosperity and development, China’s telecommunications industry, there are a variety of acute problems which impede the enhancement of quality of telecommunications services in China, but also limits the telecommunication enterprises to the world of China’s telecom giants to compete with the world pace.In this paper, the basic properties of the telecommunications industry in theory start to discuss the telecommunications industry with various economic attributes of the much-debated special attention to the natural monopoly of telecommunications properties, by analyzing the telecommunications industry in various stages of development in the respective monopoly and competition play a different role, but is also indispensable, demonstrate the telecommunications industry monopoly and competition can co-exist and are inseparable from the common constituent elements of the telecommunications market. And by analyzing the history of telecommunications development in various landmark events, as well as supervision of other countries in the telecommunications industry to gradually explore the experiences and lessons learned are discussed in today’s telecommunications industry, stage of development, how to carry out effectively the telecommunications industry, the scientific, can promote the sustainable development of the telecommunications industry and the prosperity of the method.Western countries, the course of development of telecommunications is a mirror, from China’s telecom industry can be summed up a lot of experience and lessons learned. Although our institutional vary with the Western countries, but the telecommunications industry is an unalterable law of development, we can we find out a suitable and consistent with China’s national conditions and development of telecommunications law reform.We can not be denied that China’s telecom market is still in a highly monopolistic and inefficient competition stage, the telecommunications regulator complex and low efficiency, several unsuccessful re-confirmed the orders of telecommunications regulation and rely on the monopoly of access to telecommunications development is not in conformity with the law. Telecom Reform from the experience of the West, we should be able to find and establish a sound legal framework, through the framework of the two core industry-specific laws and regulations and competition laws in accordance with law to conduct joint supervision of the telecommunications industry is an objective and effective. This is to appeal to China’s telecom industry regulation as soon as possible a special Law "Telecommunications Act" in order to clear the telecommunications industry regulator, the telecom market access, telecom companies to control, restrict the monopolistic behavior of dominant companies and introducing competition mechanism, the implementation of the non - symmetry control and so on. Has been issued through the "anti-monopoly law," the monopoly of the telecommunications market in the conduct of severe sanctions, to eliminate restrictions on competitive behavior. Through the establishment of sound regulatory legal regulation, and constantly get rid of restrictions on China’s telecommunications ahead unreasonable obstacles to the realization of China’s telecommunications industry and telecommunications companies around the world for large-scale development.
