Abstract


China is experiencing a sustained period of population of aging process, the growing elder population, is making China the world have not become rich first, a typical old country. As the world’s largest developing country, social, especially the Government can be used for pension cause of human, material and financial resources are very limited. However, the community service for old-age pension is rigid, in this form, the most typical non-governmental pension institutions - old apartments came into being.Old apartment as current a form of private pension institutions to meet some of the older home and social old-age pension needs of China’s pension problems to solve an effective supplement.As the pension issue relates to the immediate interests of millions of households and social harmony and stability, so this paper will address the pension institution-building and civil legal issues related to the use of the scientific concept of development research, analysis of China’s institutions and private pension-related legal issues, and By combining our national conditions and learn from the successful experience of foreign non-governmental pension institutional development suited to China’s claims in the hope for China’s private pension sector development into the legal system to pay their own meager strength.As the private pension institution-building not only has the nature of an enterprise but also of social welfare in nature, which determines its development and improvement of government, society, communities in the human, material and financial resources, etc. support.Old-age needs of the elderly is not simply money, support, more important is that someone can provide them with the corresponding pension service because of the increase with age, physical condition are less and less satisfactory, and even loss of self-care ability, money on their The significance is not so important, when there is a need to provide them with necessary services, but who is going to provide these services?
