Abstract


Electronic bank is not just for the existing banks sell their products and services has opened up a new type of sales channel, and not transfers the existing banking business to the electronic network easily, more importantly, has changed the Management Patterns and philosophy of traditional bank, has formed a new industrial organization of banks, is a result of the information revolution change the social system reflected in the financial field, will certainly have a profound impact on modern financial theory and practice.In spite of the author, a bank employee in the past, but at the same time like other ordinary customers of banks have been using E-banking products, in the sense of electronic banking convenient, but also deeply feel the great risks of electronic banking. Despite causing the risks of electronic banking are many reasons, but the lack of effective government regulation of electronic banking in view of this writer is the root cause, mainly embodys the lack of a effective and sound legal system of the building in the development of electronic banking.In this paper, the logical thought is: As e-banking is a new problem in itself, first the basic aspects of electronic banking, such as definitions、characteristics and so on to be defined and described, and to analyze the risks of electronic banking, because of the risk we must to control it, and then put forward questions——e-banking supervision legal system challenges. Secondly, access to the main body of this article——on the domestic and foreign legal system of electronic banking supervision practice analysis: first, a comparative analysis of foreign representative electronic bank control system are used, and derive inspiration; further using historical method to analyze the current situation and problem of Chinese E-banking supervision legal system. Finally, electronic banking supervision in China’s legal system building ideas put forward.
