Abstract


Recently, "Hitch-Hike" has been getting more and more popular, even professional net built for giving some service. Research into "carpool" to drivers in some large cities such as Beijing, Shanghai, Guangzhou, Nanjing, Nanning, Guilin shows :95% of drivers agree to "carpool";90% of people intending to buy cars will wish to do the "carpool" with their relatives ,friends and colleagues; more than half of them has begun or planned to do it. In short, "carpool" not only can decrease the cost, but also protect environment and relax traffic jams. On the other hand, the faults of "carpool" cannot be denied: whether is "carpool" legal in china? And what is relationship between parties? In case suffering of traffic accidents, how to divide of the responsibilities? How to determine who should undertake the responsibility?And then how about account ability? Whether the impunity is illegal between parties?Based on analyses to all kinds of "carpool", in order to prove its legal. Meanwhile through analyzing various of "carpool" concepts, we can draw some conclusions about questions above. And I wish to inspire the people who need it. Meanwhile, giving some hints to compensate for gaps in the theory. So it is of worth wealth.
