Abstract


In order to solve the current exist in the field of labor and employment labor contract term phenomenon , to achieve a stable and harmonious labor relations, January 1, 2008 implementation of the new \on worker protection, reflecting the \conditions, procedures and legal consequences of the provisions have yet to be further clarified and improved , resulting in social life and in practice , on the non-fixed term labor contract there are still many misunderstandings and disputes , the interests of workers and employers can not wait for an effective balance . Therefore it is necessary to conduct in-depth study of the labor contract . Besides the introduction and conclusion, the text of this paper consists of four chapters : the first chapter of a labor contract without a fixed term fundamental theoretical problems of this chapter by a labor contract without a fixed term concept, characteristics , China's non-fixed term labor contract system describes the evolution of the legislative , turn right without a fixed term labor contract system value analysis and positioning . Chapter II of non-fixed term labor contract system Commentary This chapter of the \find one 's progress and deficiencies. Chapter III without a fixed term labor contract extraterritorial model by comparing with comparative analysis in this chapter is a representative of the French civil law model, the Japanese model and the Taiwan model , combined with the actual situation of China's labor market , looking for our reference system to adapt to China's national conditions or methods . Chapter IV improve our non-fixed term labor contract system proposed combination of non-fixed term labor contract system legislative value objectives, and in conjunction extraterritorial legislation proposed on the basis of experience improve our non-fixed term labor contract regime.
