Abstract


The right to health is a basic human right in theInternational Covenant on Economic, Social and Cultural Rights(ICESCR).The World Health Organization for the first time wrote the right to health in the charter of the World Health Organization:“gaining the highest attainable standard of health is a basic human right”. Today, the right to health is what the international community, all countries.I believe ,The government is the main subject of obligation to protect citizens’rights to health,,that is citizens who are in the normal condition of the body and spirit,have the right to be given national health care.Since WHO Charterfirstly initiated that the right to health should be protected half century ago, many countries has confirmed health right in their constitutions and take effective measures to ensure it. After research I believe that,To protect the right to health through the constitution and to prevent the illegal intrusion of the public power,“writing the right into the constitution"should be the first step, Our constitution should declare it as a basic civil right and increase contents of procedural items.This article elaborating the concept、contents、and properties of the healthy concept and right to health in a specific way, And focuses on our right to health in the Constitution of the necessity and feasibility of,Meanwhile entered the constitution to the healthy power the concrete construction to make certain tentative plan.
