Abstract


Agriculture intellectual property protection system is established , after a lengthy period of time , it is with a country's economic development and developed . Currently, most countries in the world have established their own basic agricultural legal system of intellectual property protection , some developed countries tend to be more perfect in this regard . Practice has proved that agriculture intellectual property for a country, the nation 's survival and development , for the socio-economic progress is essential. As the world trend of economic globalization and the rapid development of science and technology , agriculture intellectual property protection will become increasingly widespread concern by the international community . In a certain sense, agriculture is the intellectual part of the intellectual property rights , it is in a state of utilization , reflecting the country's scientific, technical and cultural level . Trade integration in the world economy matures today, the application of advanced scientific and technological achievements in agriculture has become the most important countries in the development of agricultural means of production , particularly for developing countries is even more important . From such a big international background, with an international vision for our existing system of legal protection of intellectual property of Agriculture , will find in many respects still can not cope with the current international situation . Although China's intellectual property protection is a comprehensive convergence with international standards and practices , but compared with developed countries there are still some gaps. How, then, combined with China's national conditions value choice , the idea of ​​economic globalization on intellectual property protection requirements , adjustments have some intellectual property legal system, establish and improve agriculture with Chinese characteristics, legal protection of intellectual property rights regime , they become legal work and the study researchers focus. This paper studies the \China's agricultural system of intellectual property protection laws to make reasonable suggestions . Part I: The concept of intellectual property rights on agriculture and legal characteristics defined. Agricultural Property is a relatively new concept , along with the biological engineering, hybrid seed technology and eco-friendly new pesticides and agricultural information technology products as the representative of agricultural high-tech industry development and gradually produced .
