Abstract


Since the 19th century , the social security system is gradually being national attention and continues to improve, although scholars have been debating the nature of the right to social security , but the right to social security has long been not a new term . The Social Security Act has also become an important branch of the Law disciplines . Mr. Qin Hui said: The essence of the problem is the problem of farmers , farmers' problem is the biggest problem in our country , which can not be ignored in a developing country and beyond . Therefore , in our recent social security system in rural areas and the right to social security of farmers has also become theorists hot issues , economics , political science , sociology scholars in the field of study of social security from different angles . However , the right to social security for farmers , especially to talk about the right to social security of farmers from a human rights perspective , but also appears to be very weak . Based on this, we tried to start with an overview of the social security system , structure of urban-rural dual system through a bundle of data comparison , reflects the huge gap between urban residents and farmers on the right to social security , reveal our farmers in Social Security rights are worrying situation . And then focus on the foundation and theoretical foundation of the rights of the farmers ' social security rights to be demonstrated to the farmers enjoy the legitimacy and necessity of the social security to expectations caused jurisprudence widely concerned about the fate and rights of farmers , and the state and society more respectful of peasant society protection of the right to protect the fundamental rights of the farmers of the realization . The article is divided into four sections to explore the social security rights of our farmers . The first part is an overview of the social security system and social security rights , which is the basis of this article on the right to social security for farmers . The social security system and social security rights as the starting point , a basic history of visits by the development of the social security system of the Western , the author of the social security defined as a positive obligation of the country . And a broad understanding of China 's social security rights , that of the right to social security , including social insurance , social relief , social welfare , excellent set appease , accumulation of social mutual assistance and personal security .
