Abstract


Third-party system in the WTO dispute settlement mechanism to occupy an important position, it is the dispute settlement mechanism of judicial and arbitrary phase- difference is one important indicator . In relation to the WTO dispute settlement , it is usually the case , WTO members to not direct the prosecution or the respondent party , but rather the identity of third parties involved in the dispute settlement procedures to go. It is no exaggeration to say that today almost all of the entry into the WTO dispute settlement procedure cases , there will be one or more third-party intervention in which a third party intervention along with the development of the WTO dispute settlement mechanism of WTO member countries more and more attention. Early in the GATT / WTO before the idea of ​​a third party to intervene in the proceedings in the domestic and international justice prevalent , but \This article along the GATT / WTO dispute settlement mechanism of the historical trajectory third-party involvement , in order to investigate the empirical analysis method for third-party intervention under WTO rules and practices ; while the existing DSU third-party issue detailed regulations on analysis, that the progressive nature of the existing rules and narrow and ambiguities .
