Abstract


From our different periods introduction of the \2008 \statutory functions. However, emergency rescue brigades perform functions still exist five obstacles, namely: Team is not perfect, that many places do not rely on the public security fire brigade to establish a comprehensive emergency rescue team or create work in place; management system that is not, that is, Armed Forces and Police combine to form brigades reality, the law does not explicitly command of brigades ultimate question of attribution, emergency rescue brigades perform functions increasingly facing legal risk; comprehensive capacity shortage, which has long are based on a certain type of accident disaster management of the special emergency rescue capabilities; linkage poor response mechanism, namely all kinds fragmented relief agencies, the integration is not enough; police force is not enough, there can not fulfill the actual needs and contradictions. In order to promote public security fire brigade emergency rescue functions to better fulfill the need for further summarized and experience, from the legal improve public security fire department functions, including emergency rescue functions in order to save lives and property safety of other functions based; and efforts to eliminate brigades to fulfill the functions of a comprehensive emergency rescue obstacles, mainly administrative system should be shifted from the department of public administration institutions of the management system in order to eliminate obstacles to shift from the traditional professional rescue rescue in order to eliminate obstacles to comprehensive capacity deficiencies and establish a scientific perfect linkage linkage poor response mechanism to eliminate the barriers, multi-channel, multi-form reinforced police troop strength is not enough to eliminate the obstacles. Finally, practical measures and academics from around the theory of legal measures should be timely, the rule of law to protect public security fire brigade emergency rescue functions to perform, thus opening a comprehensive emergency rescue rule of the road.
