Abstract


Under internet circumstances , openness of internet brought the great influence of faster speed and larger scope, it has take deeply society influence on raising towards the fame of works and authors, and it takes more benefit to the social civilization. But strong duplicated function and non-regional of internet make works lost the control as soon as it is upload to the Internet. There have a legal problem which must be emphasis and solved is how to reach balance condition between the copyright interest with the public interests . The article divided four parts . The first part has aim at one new topic about internet environment protection , reveal to expansive right of the audiovisual work under internet environment , get conclusion that the audiovisual work would be interloped easier. The second part analysis the change of use legal relation the audiovisual work, research the individual point of the audiovisual work from three aspects: subject 、 object and content ,treat the variety and specialty of the audiovisual work .The third part have compared fair use Privilege of different country, made a conclusion that fair use Privilege was a necessary tool to make balance between author"right with user" interests under internet circumstances.
