Abstract


In the countries of the contemporary world economic exchanges , the agent has become one of the most common legal form . Both in the domestic and international economic and trade activities , the agent system has been widely used ; either common law countries, countries are required as an important legal system in civil and commercial law or civil law . Foreign trade agency as a form of proxy , application and adjustment should follow the general agency system requirements . Analyzed and discussed from three aspects . The first part of the basic theory of the agent system , the depth of the three major problems: Agent System , development and significance ; proxy and power of attorney ; rights and obligations of the agent and the principal . The second part of the method of comparative analysis , based on the status of the development of major countries in the contemporary law of agency , the theoretical basis of the two legal systems on the international common law and civil law countries agent system , the type of agent , the origination and termination of the agency relationship the reasons for the Agent and the legal effect of a more comprehensive and detailed study . The third part the newly revised \First analyzes the status quo of China 's foreign trade agency system and problems , followed pointed out the future direction of development of China's foreign trade agency system that separate or specialized regulation of foreign trade agency system should not continue to exist within the Foreign Trade Agency System unity is the trend . On the basis of this view , but also put forward some specific views .
