Abstract


At present, although China刑法理论界has strengthened function of criminal law protection of human rights , but the proper conduct of business regime research is still in a relatively weak phase. Either for legitimate business concepts and types of behavior or conduct legitimate business justification for the basis and justification of the standard value of the basic theoretical research , are still not deep enough . However , social practices are constantly evolving field of business behavior is complex , so people on the nature of these behaviors are difficult to make a correct identification. Therefore, strengthening the theory of proper business conduct research to guide practice has become a pressing issue . In this paper, the basic methods of legal research on the three most legitimate business behavior analysis theory are discussed . Introduction to proper business conduct some in-depth analysis of the legal property of proper business conduct , behavior, properties and normative components , and in the comparative reference , based on the proper conduct of business under the connotation of the concept of a more scientific and rational definition. Meanwhile, the analysis of the existence of legitimate business practices areas and specific types of behavior associated with legitimate business relationships do proper conduct a comparative analysis . In the body of proper business behavior - based and value parts , focusing on the proper conduct of legitimate business under that act both legitimate business conduct consistent with other legitimate unified basis has its unique foundation. In addition , this section also discusses the behavior of the three legitimate business value , namely the value of human rights , justice, values ??and liberal values ??. The third part , namely the establishment of proper business conduct requirements section analyzes the elements of proper business conduct established research significance and status , focused on the establishment of proper business conduct requirements that the establishment of proper business conduct must meet four conditions , that the legitimacy of the business , the legitimacy of actors , actors subjective element of legitimacy and the legitimacy of acts of objective elements . Article concludes that the full realization of human rights protection function of criminal law , our criminal law is necessary to learn from other countries, civilization, clearly defined in the criminal law system of proper business conduct .
