Abstract


In pace with the development of market economy in our country, the market has become the primary mode that plays a basic role in the allocation of resources and the economic means to optimize the limit resources. The market economic activities are connected by the contract of every independent market player. To ensure everyone can obey the justice of these contracts, we need a perfect law system to protect it. So the market economy is legal economy. This requires us to speed up the construction of legal system, on the other side, it requires the government to exercise state power according to law and regulate the procedure of work. Without regulation government behavior, there is no regulation market. The administrative system in our country now was formed under planning market environment. Thought reformed for some years, the system is better than before. But there are many problems according to the need of market economy. Firstly, the structure of administrative system is not in line with the requirement of market economy such as too many levels, duplicate law enforcement. Secondly, the governmental functions have not been completely changed. The phenomena of government interfering the market directly still exist everywhere. Thirdly, the behavior of government sometimes is illegal. The exercise of administrative functions according to law is still far away to us.
