Abstract


The virtue and the rule of law of pre-Qin Dynasty is not only an old and new topic,but also a topic which can contact the Chinese ancient and modern history,the relevant discussion of it has been too numerous to mention. Virtue and the rule of law is the basic strategy of governing the country,the Confucian of pre-Qin Dynasty pushing the virtue,advocated to use the ethics to govern the country;the Legalists of pre-Qin Dynasty pushing the rule of law,advocated to use punishment and reward to govern the country.Though the methods of virtue and the rule of law are different,but in the final analysis is to maintain the feudal rule of man.This artical begin with to analyze the philosophical and social foundations between virtue and the rule of law ,discuss the authory of them,in-depth study of the historical limitations of two methods of running the country, at the same time, fully dig out the modern vaule of virtue and the rule of law of pre-Qin Dynasty, in order to play its contemporary reform and opening up and socialist political civilization and spiritual civilization construction guidance and reference.
