Abstract


Freedom of speech, freedom of the press is one of the fundamental rights of the citizens . The First Amendment of the U.S. Constitution clearly stipulates the Congress shall make no deprivation of freedom of speech, freedom of the press law . As the mass media is a tool and a means of expression and the most effective , when a handful of people control what point of view to be expressed , the speech of ordinary people to decide according to their own commercial interests , freedom of the press would be extremely limit . Therefore, to achieve diversification of ideas , we must recognize and protect the rights of use of the mass media . The so-called close to the right (right of access to the media), refers to the use of the mass media to express thoughts, ideas and opinions , as well as the right to release information . Close to the right is a constitutional right to be protected by the First Amendment of the U.S. Constitution . The theoretical foundation close to the right is the correction of the idea of the \According to this theory , close to the realization of the right can not be separated from the limited intervention of the government mass media . Admittedly, close to the right to freedom of the press of the mass media is a conflict exists . When the government intervene in the mass media to protect close to right , the mass media are often filed unconstitutional v. government to infringe upon their freedom of the press as an excuse . Judicial practice in the United States show that close to power in the extent to which the protection of the law , depending on the nature of the mass media , the identity of expression , as well as factors such as the content of speech . In this paper, the the specific judicial precedent , a more detailed analysis of the legal system of the United States close to the right . China today , the medium of speech discrimination also widespread, consistent with the public interest point of view it is difficult to be fully expressed , therefore , media close to the recognition and protection of the right to be imperative .
